Fort Atkinson Regular City Council Minutes September 6, 2023

Mayor Paul Herold called the regular meeting of the Fort Atkinson City Council to order at 6:00 P.M. on September 6, 2023 at the Fort Atkinson Community Center.  Present were: Glass, K. Schmitt, P. Schmitt and Schroeder.  Leuenberger was absent.  Also present were: Paul Herold, Michele Elsbernd, Ron Franzen, Tom Madden and Steve Kelsay.

Motion by Glass, second by Schroeder to approve the consent items (minutes from August 2, 2023, clerk/treasurer reports and claims) All ayes. Carried.

Motion by K. Schmitt, second by Glass to approve Resolution # 384 authorizing and approving a Loan and Disbursement Agreement and providing for the issuance and securing the payment of $ 1,984.600 Sewer Revenue Bonds, Series 2023.  All ayes. Carried.  This amount is less than previously stated due to the return of the Initiation Fee from the original loan.

Tom Madden was present and stated that the well is basically completed but are waiting for the electrical components to come for the well house.  He presented Pay Request # 3 for Shawver Well in the amount of $ 51,980.20 which is all but the retainage.  Motion by P. Schmitt, second by Glass to approve Pay Request # 3.  All ayes. Carried.  A contract change order # 3 from Blazek Corporation was received asking for a time extension until October 30th due to the delay in receiving the electrical components needed.  Motion by K. Schmitt, second by Schroeder to approve Contract Change Order # 3.  All ayes. Carried.  Pay Request # 7 from Blazek Corporation in the amount of $ 81.332.16 was presented.  Motion by Schroeder, seconded by Glass to approve PPE#7.  All ayes. Carried.

Ron Franzen addressed the council with updates on the old tanker stored at the lagoon building and update on the summer band concerts.  He also stated there may be a notice of open burning ban coming for Winneshiek County.

Motion by K. Schmitt, second by Schroeder to approve the second reading of Ordinance # 34 raising the cost of water in the city.  All ayes. Carried.   The clerk will put together a spreadsheet of water rates in the area.

Greg Barta was absent but the need for a brush mower and tractor was discussed.  Steve Kelsay stated that the County would be replacing one of theirs and that it may be an option for Fort Atkinson.

Motion by P. Schmitt, seconded by Glass to approve the building permit for Bob & Laure Rausch. All ayes. Carried.

Information was shared from the City Attorney regarding annexation. The city will not pursue this option.

A draft copy of the recent Audit report was shared with the council.

Myles Kupka sent a letter of resignation from the Historic Preservation Commission.  Motion by P. Schmitt, second by K. Schmitt to accept the resignation.   All ayes. Carried.   Information was received regarding our Historic Preservation Ordinance.  According to state regulations we can have no fewer than 3 members and they can serve a staggered term for a minimum of three years.  The current city code will be amended changing the number of members and the term from three to two years.

A written band concert report was submitted to the council.

The yearly library report was submitted to the council for review.

Information has been received from the DNR and FEMA regarding the need to update the City of Fort Atkinson’s floodplain ordinance.   The DNR sent a draft copy with all required items and the city will fill in the city information.  A public hearing will be held and the ordinance adopted at a later date after review by the Mayor.

Steve Kelsay was present and he shared information regarding the change in state tax laws,  Area water rates were discussed and he stated he presented a copy of the book, A History of Mills and Water-powered Sites of Winneshiek County to the Fort Atkinson Library.

Motion by K. Schmitt, seconded by Schroeder to adjourn.  All ayes. Carried.  Meeting adjourned at 7:10 P.M.
