FORT ATKINSON REGULAR CITY COUNCIL MEETING JUNE 5, 2024
Mayor Paul herold called the regular meeting to order at 6:00 P.M. on Wednesday, June 5, 2024, at the Fort Atkinson Community Center. The meeting was opened with the Pledge of Allegiance. Present were Glass, P. Schmitt, K. Schmitt, Leuenberger. Schroeder was absent. Also present were Greg Barta, Michele Elsbernd, Steve & Marta Kelsay.
Motion by Glass, second by Leuenberger to approve the consent agenda (claims, minutes of 5/1/24, clerk/treasurer reports, cigarette permits for Huber’s, Lickety Split, The Fort and the ABD license for The Fort) Roll call: All aye, motion carried.

Mayor Herold declared the public hearing to consider vacation of a parcel of city street right-of-way and conveyance of city property to David & Dianne Nienhaus. There were no comments, and the mayor declared the hearing closed. Motion by K. Schmitt, seconded by Leuenberger to approve Ordinance # 38 vacating a portion of a parcel of city street right-of-way known as Oak Street and to waive the subsequent reading. Roll call: All aye, motion carried. Motion by Leuenberger, seconded by K. Schmitt to approve Resolution # 391 to convey a portion of a vacated street right-of-way to David & Dianne Nienhaus. Roll call: All aye, motion carried.
Tara Hoffert was present to discuss the city insurance renewal. Quotes have been received from ICAP and IMWCA and EMC is requesting additional information before they quote. Both quotes will be reviewed, and a decision made before the July 1st deadline.
Motion by P. Schmitt, seconded by Glass to approve Resolution # 392 setting a public hearing to consider vacation of a part of alley right-of-way located in Block 48 of Bradleys Subdivision and conveyance of city property to George & Shirley Tupy. Roll call: All aye, motion carried.
Motion by K. Schmitt, seconded by Leuenberger to approve Resolution # 395 setting a public hearing to consider vacation of 2024-7,8,9,10 & 11 all in the alley in Block 11 and approve conveyance to Todd & Kelsey Schmitt, Paul & Bette Schmitt, Scott & Mary Sindelar and Marvin Krivachek. Roll call: Aye: K. Schmitt, Glass, Leuenberger. P. Schmitt abstained. Motion carried.
Motion by Leuenberger, seconded by P. Schmitt to approve Ordinance # 40 adding fences to the building permit required portion of the city code. Roll call: All aye, motion carried. Motion by K. Schmitt, seconded by Leuenberger to waive the additional readings of Ordinance #40 and make effective upon posting. Roll call: all aye, motion carried.
Steve Kelsay addressed the council to update on Winneshiek County issues that affect the City of Fort Atkinson.
Greg Barta updated the council on city maintenance issues. A flushing hydrant installed at the east part of Elm Street; he stated only six more to go. He stated that the wildflowers will be planted at the well site next week and the controls for the well were discussed. Motion by Leuenberger, seconded by K. Schmitt to approve the quote for the well controls as proposed by Decorah Electric. Roll call: all aye, motion carried. Oak Hill cemetery and a few nuisance properties were discussed. It was also noted that the renter of the Shatek property adjacent to the Pavlovec property had encroached on the city right-of-way which was seeded as grass last year. A letter will be sent to the property owner.
The city park playground area was discussed, and all felt they would like to update and install new equipment, but city funds are not available. K. Schmitt and Leuenberger volunteered to set up a committee to recruit volunteers for fundraising.
Motion by K. Schmitt, seconded by Leuenberger to approve the building permit for Larry & Margaret Riha. All aye, motion carried.
Motion by Leuenberger, seconded by P. Schmitt to adjourn. All aye, motion carried, meeting adjourned at 6:57 P.M.
