FORT ATKINSON REGULAR CITY COUNCIL MEETING

JANUARY 4, 2023

 

Mayor Pro tem Kay Schmitt called the meeting of the Fort Atkinson City Council to order at 6:03 P.M. on Wednesday, January 4, 2023, at the Fort Atkinson Community Center.  Present:  Glass, P. Schmitt, K. Schmitt and Leuenberger.  Also present: Michele Elsbernd, Tom Madden, Ron Franzen and Jay Schwamman.   Absent were Mayor Paul Herold and council person Lori Schroeder.

Tom Madden updated on the Lagoon project. He stated Alliant was on site to install electric access, the cells all passed the leakage test, the building was nearing completion, the control panel is expected to arrive next week, and the status of the needed generator is still unknown.  The generator was discussed and the need for LP tanks to fuel the generator.   He also updated on the well project.  He stated Shawver is scheduled for mid to late February.  He presented pay request # 2 to Blazek Corporation in the amount of $ 5586.17 for stored materials.   Motion by Glass, second by Leuenberger to approve pay request # 2.  Aye:  K. Schmitt, P. Schmitt, Leuenberger & Glass. Motion carried.   He discussed proposed change order # 1 for the well project which included a negative change in cost due to going from a pre-cast building to stick built, also cost increase for the two generators due to the size of well pump installed at current well and estimated size for the new well.  A culvert was also added to the entrance of the well site.  The change order total is a -$ 1904.00.  This was discussed and council agreed and will be formally requested at the next meeting.  Also discussed was the need for lp tanks for the generators at the current well site and the new well site.  Cost to install electricity to the well site and the lagoon site was discussed and noted that these costs were not included in the construction contract.

Mayor Pro tem Kay Schmitt opened the public hearing on the vacation of a part of third street right-of-way located in the City of Fort Atkinson, Iowa, and the conveyance of City property to David Humpal, Charles and Arlene Lynch, Dale and Jennifer Leuenberger and Brian Leuenberger.  There were no written questions or comments and council answered questions from the public.  The public hearing was closed.   Motion by Glass, second by P. Schmitt to approve Ordinance # 32 to vacate a part of third street right-of-way located in the City of Fort Atkinson, Iowa.  Aye:  Glass, P. Schmitt, K. Schmitt. Leuenberger abstained, motion carried.  Motion by P. Schmitt, second by Glass to waive subsequent readings of Ordinance # 32 and make effective upon notification by posting.  Aye:  Glass, P. Schmitt, K. Schmitt.  Leuenberger abstained.  Motion carried.  Motion by Glass, second by P. Schmitt to approve Resolution # 362 approving the conveyance of a part of third street right-of-way located in the City of Fort Atkinson, Iowa to David Humpal, Charles and Arlene Lynch, Dale and Jennifer Leuenberger and Brian Leuenberger.  Aye: Glass, P. Schmitt, K. Schmitt.  Leuenberger Abstained.  Motion carried.

Motion by P. Schmitt, second by Glass to set the date for the public hearing on the Max Budget Levy for February 1, 2023, at 6:00 P.M. at the Fort Atkinson Community Center.  Aye:  Leuenberger, P. Schmitt, K. Schmitt, and Glass.  Motion carried.

Representative of St. John’s parish were not in attendance, this item will be added to a future agenda.

Motion by Leuenberger, second by P. Schmitt to approve Resolution # 360 setting the meeting time for the monthly regular meetings to 6:00 P.M.   Aye:  Leuenberger, P. Schmitt, Glass, and K. Schmitt.  Motion carried.

Motion by Glass, second by Leuenberger to approve Resolution # 361 directing the clerk to publish notice of hearing on the adoption of the proposed “Code of Ordinances of the City of Fort Atkinson, Iowa.   Aye:  Glass, P. Schmitt, Leuenberger and K. Schmitt.  Motion carried.

Motion by Leuenberger, second by P. Schmitt to approve the consent items (minutes of the November 30, 2022, and December 13, 2022, meeting minutes, clerk’s reports and claims for December 2022.   Aye:  K. Schmitt. P. Schmitt, Leuenberger and Glass.  Motion carried.

There were no building permits submitted.

Motion by P. Schmitt, second by Glass to approve the Calmar Courier as the official newspaper for the City of Fort Atkinson, Iowa.   Aye:  K. Schmitt, P. Schmitt, Leuenberger and Glass. Motion carried.

Motion by Glass, second by Leuenberger to approve appointment of the officers of the Fort Atkinson Fire Department.   Chief:  Ronald Franzen, 1st Assistant Chief-Keith Herold, 2nd Assistant Chief-Jay Schwamman, Treasurer-Jim Schmitt, and Secretary-Chelsey Brummond.  Aye:  Leuenberger, Glass, K. Schmitt, P. Schmitt.  Motion carried.

Ron Franzen and Jay Schwamman updated the council on the status of their new pumper truck.  The truck has arrived and is operational with some items still to be installed.  They discussed with council the possible uses/sale of the old truck.  Jay Schwamman wished to acknowledge Chief Ron Franzen’s 49 years as Fort Atkinson Fire Chief.

The council agreed to sponsor Community Foundation grants for the Fort Atkinson Museum (cabinets) and the Fort Atkinson Fire Department (generator for their building).
